CHOICE HOTELS AUSTRALASIA BOOK & STAY PRIZE DRAW

Terms and Conditions

1. Information on how to enter and prizes form part of these terms and conditions.Acceptance of a prize is deemed acceptance of these terms and conditions.

2. The Promoter is Choice Hotels Australasia Pty Ltd (ABN 41 081 959 891) of 150 Jolimont Road, East Melbourne, VIC, 3002, (03) 9243 2400 (Promoter).

3. The promotion commences at 12:01am (AEST) on 15 April 2008, and closes at 11.59pm (AEST) on 15 November 2008. (Promotion Period).

4. Subject to paragraph 6, entrants must be aged 18 years or more (Eligible Entrants).

5. Eligible Entrants will receive entries in the draw when they:

• Make a valid hotel booking via choicehotels.com.au or choicehotels.co.nz and provide their name, a valid email address, telephone number, state, postcode, country of residence at the time of booking;
• Choose to opt in to the prize draw and receive future email communications from Choice Hotels;
• And stay at a Comfort, Quality or Clarion hotel in Australasia (Australia, New Zealand, Singapore and Papua New Guinea) during the promotional period 15 April 2008 - 15 November 2008.

6. To enter the competition, Eligible Entrants must:

• Be an Australian resident or New Zealand resident only.
• Have booked via www.choicehotels.com.au or www.choicehotels.co.nz and stayed at a Choice Hotel in Australia, New Zealand, Papua New Guinea and/or Singapore during the promotional period 15 April 2008 and 15 November 2008, entered a valid email address and selected to opt in to receive more Choice Hotel offers via email.

7. The Promoter will not be responsible for any late, lost or misdirected entries.

8. Directors, management, employees and their families of the promoter, each of their related bodies corporate are not eligible to enter this promotion.

9. All entries will go into a national draw to be conducted by the Promoter on 20 November 2008 at the offices of Choice Hotels Australasia Pty Ltd, 150 Jolimont Road, East Melbourne, VIC, 3002, Victoria, Australia at 3:00pm (AEST). The winners will be notified by mail and their names published in The Australian on 23 November 2008.

10. The result of the draw is final and no correspondence will be entered into.

11. The first valid entry drawn will win the major prize based on winners country of residence (Australia and New Zealand):

FOR AUSTRALIAN RESIDENTS:
Two (2) return flights into any capital city in New Zealand, departing from the winner?s nearest Australian capital city, five (5) nights accommodation for two (2) adults at a participating Choice hotel (Comfort, Quality or Clarion) in New Zealand, five(5) days standard car hire with Europcar in New Zealand (valued at AUD$500 in an economy, compact, intermediate, standard or full size car). The approximate (maximum) value of the Australian resident prize is:AUD$4500. The prize is subject to availability and must be taken within 12 months of the draw date. Exact hotel locations will be confirmed between Choice Hotels Australasia and the prize winner. Prizes are not transferable or exchangeable or redeemable for cash or any other goods and are a complete package, prize components must be used together. Travel insurance is not included but recommended.

FOR NEW ZEALAND RESIDENTS:
Two (2) return flights into a major capital city in Australia, departing from the winner?s nearest capital city, five (5) nights accommodation for two (2) adults at a participating Choice hotel(Comfort, Quality or Clarion) in Australia, five (5) days standard car hire with Europcar (valued at AUD$500 in an economy, compact, intermediate, standard or full size car). The approximate (maximum) value of the New Zealand resident prize is: NZ$4500. The prize is subject to availability and must be taken within 12 months of the draw date. Prizes are not transferable or exchangeable or redeemable for cash or any other goods and are a complete package, prize components must be used together. Travel insurance is not included but recommended.

12. The maximum total value of all prizes is AUD$9000 and is based on the recommended retail value and the exchange rate at the time of printing. The Promoter does not accept any responsibility for any variation in the value of a prize.

13. The prizes do not include travel insurance, passports, visas, meals, ticket taxes or charges, ground transportation, additional accommodation (except where stated) or any other costs of a personal nature not stated. Compliance with any health or other government requirements is the responsibility of the winner.

14. Each prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. The prizes are not exchangeable or redeemable for cash or other goods or services and cannot be taken separately. Subject to these terms and conditions, the prizes can be transferred to another person, should the winner be unable to accept the prize.

15. The Promoter, its respective related bodies corporate, officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect or consequential loss) suffered or sustained in connection with this promotion, the promotion of this promotion or the use of any prize, except for any liability which cannot be excluded by law.

16. The Promoter reserves the right to redraw in the event of an Eligible Entrant being unable to satisfy these terms and conditions or forfeiting or not claiming a prize. If a prize remains forfeited or unclaimed as at 24 February 2009, the Promoter will hold a second chance draw on the 25 February 2009 at the offices of Choice Hotels Australasia Pty Ltd, 150 Jolimont Road, East Melbourne, VIC, 3002, Victoria, Australia. Subject to any written direction given under applicable law. Unless the winner is a South Australian resident were any unclaimed prizes will be subject regulation 37of the lottery & gaming regulations 1993

17. Comfort, Quality, Clarion and associated logos are registered trademarks and used under license from Choice Hotels International Inc.

18. This promotion is subject to the Promoter?s Privacy Policy set out in the Annexure to these terms and conditions. Entry details remain the property of the Promoter and will be used for electronic direct marketing purposes by Choice Hotels Australasia. Without limiting the generality of the attached Privacy Policy, the name and photograph of the winner may be used to comply with the law in the conduct of this promotion and for promotional purposes.

Choice Hotels Australasia does not sell or make available your information to any marketing agencies or database not associated with Choice Hotels Australasia. Choice Hotels Australasia complies with the National Privacy Principles contained in the Privacy Act 1988.

What kind of personal information do we hold?

Personal information is defined as information or an opinion that can identify a person. The type of personal information collected by Choice Hotels Australasia from its customers depends on the type of transaction you are undertaking with us. If you are making a reservation then only the information required to effect and confirms the reservation will be collected.

How do we collect your personal information?

Choice Hotels Australasia collects personal information in various ways, including; when you are making a booking through our centralised reservations system, through the Global Distribution System (GDS) or through our website.

How do we use your personal information?

Your personal information may be used in order to: Provide the services that you require Administer and manage those services, including billing Conduct appropriate checks for credit-worthiness Maintain and develop our business systems and infrastructure including testing and upgrading of these systems.

To whom do we disclose your personal information?

To properties within the Choice Hotels Australasia system To credit card companies for payment of accounts To outsourced service providers including: - Mailing system companies - Reward program administration companies - Information technology service companies. The Choice Hotels Australasia web site does not use cookies. Information collected when you use the site and/or clicking on an Advertising banner or tile is Non-personally identifiable information. Non-personally-identifiable information is defined as information that keeps you anonymous. No details (such as your name, address, phone number or email address) are collected. Non personally identifiable information that is collected includes the server your computer logged onto, your browser type, and whether you responded to an advertisement. It also includes (totally anonymously) such things as your entry and exit points to the site, the pages you looked at, how long you spent in the site, and a number of other statistics. There will be times when we ask you voluntarily to provide personal information, such as a survey or purchase form, or when you make a reservation. In these situations, Choice Hotels Australasia or a third party engaged by Choice Hotels Australasia, collects the information on behalf of the advertiser, Choice Hotels Australasia property and/or Website. This information is used by Choice Hotels Australasia, the advertiser and/or Web site so that you can receive the services or information that you requested. Unless specifically disclosed, the personally identifiable information collected by Choice Hotels Australasia in these cases is not used to deliver personally-tailored ads to you and is not linked by Choice Hotels Australasia to any other information.

Communication by Email

If you send an e-mail message and/or attachments to any recipient at Choice Hotels Australasia Limited, the information that you send will be collected and retained by us through our automatic storage and back up system, which records each e-mail received. This information may be shared with our related entities and properties within the Choice Hotels Australasia network. This information will only be used for the purpose for which it was sent, and where necessary, to investigate and/or discipline employees.

How can you access your personal information held by us?

You have a right to access your personal information, subject to some exceptions allowed by law. If you would like to do so, please let us know.
